1. Acceptance of Terms

By downloading, installing, accessing, or purchasing a license for NovaFetch ("the Software") or browsing this website, you agree to be bound by these Terms of Service. If you do not agree with any portion of these terms, you must cease using the website and uninstall the Software immediately.

2. Software License Grant

Subject to your compliance with these Terms, NovaFetch grants you a personal, non-exclusive, non-transferable, revocable license to install and execute the Software on compatible Windows devices.

Free Tier: Access to standard resolution downloads (up to 720p) with single-stream processing.
Pro Tier (Monthly / Lifetime): Unlocks 1080p, 4K, 8K, 60fps media extraction, batch playlist queues, MP3/lossless audio conversions, and priority background acceleration.

3. Single-Device Activation Policy

Each NovaFetch Pro license key is licensed for use on one (1) active computer at a time. You may transfer your license between your devices (e.g., from a desktop PC to a laptop). However, activating the license on a new computer will automatically disconnect the previously active machine to ensure adherence to the single-active-seat policy.

4. Acceptable Use & Fair Use Compliance

NovaFetch is engineered as a productivity tool for personal media archiving, educational backups, offline viewing, content creation workflow caching, and fair use preservation. By using the Software, you expressly acknowledge and agree:

You are solely responsible for ensuring you have the legal right, authorization, or fair use entitlement to download any third-party media content.
You must not use the Software to infringe upon copyrights, trademarks, or proprietary intellectual property rights of third parties.
You must not use the Software to commercially redistribute, resell, or publicly broadcast copyrighted works without appropriate copyright holder permissions.
You must not attempt to reverse-engineer, decompile, crack, modify, or circumvent the licensing protection mechanisms of NovaFetch.

5. Third-Party Websites & Platform Changes

NovaFetch interfaces with third-party web streaming platforms (such as YouTube, TikTok, Vimeo, and others). These external platforms frequently update their streaming protocols, player APIs, and website structures. While our engineering team actively maintains and updates extraction engines to maintain compatibility, NovaFetch does not guarantee uninterrupted or permanent access to third-party services that alter their infrastructure.

6. Disclaimer of Warranties

THE SOFTWARE AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE COMPLETELY ERROR-FREE OR OPERATE WITHOUT OCCASIONAL THIRD-PARTY PLATFORM DELAYS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOVAFETCH, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE. IN ALL CIRCUMSTANCES, OUR TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE RELEVANT NOVAFETCH LICENSE.
